Please read these Terms carefully before using TurfWize. By creating an account or using the app, you agree to these Terms. If you do not agree, do not use TurfWize.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Stormwater Dynamic Solutions LLC ("Company," "we," "us," or "our"), the operator of the TurfWize application ("Service").
By downloading, installing, accessing, or using TurfWize, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using TurfWize on behalf of a business, you represent that you have authority to bind that business to these Terms.
TurfWize is a lawn care business management application that provides tools for route optimization, crew scheduling, GPS crew tracking, property mapping, task management, invoicing, and AI-powered business insights. The Service is designed for lawn care business owners, managers, foremen, and crew workers.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to users.
To use TurfWize, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for maintaining the security of your account credentials, including your PIN. You are responsible for all activity that occurs under your account. Notify us immediately at support@turfwize.com if you suspect unauthorized access to your account.
You must be at least 18 years old to create an account. By creating an account, you represent that you meet this age requirement.
One account per business is permitted. Creating multiple accounts to circumvent subscription limits or trial restrictions is prohibited and may result in termination of all associated accounts.
Subscription Plans: TurfWize offers the following paid subscription plans:
Current pricing is displayed at turfwize.com/pricing and within the app. We reserve the right to change pricing with 30 days' notice.
Billing Cycles: Subscriptions are available on a monthly or annual basis. Monthly subscriptions are billed every 30 days. Annual subscriptions are billed once for 12 months of access at a discounted rate.
Payment: Payments are processed by Stripe. By providing payment information, you authorize us to charge your payment method for all applicable fees. All fees are in US dollars.
Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled. For monthly plans, you may cancel at any time and access continues until the end of the current billing period. For annual plans, you may cancel at any time and access continues until the end of the 12-month period. No refunds are provided for unused portions of any subscription period.
Failed payments: If a payment fails, we will attempt to retry the charge. If payment cannot be collected, your account may be downgraded or suspended until payment is resolved.
Taxes: You are responsible for all applicable taxes associated with your subscription.
New users may access TurfWize free for 14 days with the following limitations: 1 client and 1 job site. No credit card is required to start the trial.
At the end of the trial period, you must select a paid subscription plan to continue using TurfWize beyond the trial limitations. If you do not subscribe, your account will be restricted to trial limits. Your data will be preserved for 30 days, after which it may be deleted.
We reserve the right to modify or discontinue the free trial offer at any time. Only one free trial is permitted per business entity.
You agree to use TurfWize only for lawful purposes and in accordance with these Terms. You agree not to:
Violation of these terms may result in immediate termination of your account without refund.
Ownership: You retain ownership of all data you enter into TurfWize, including client information, property data, job records, and invoices ("Your Data").
License to us: By using TurfWize, you grant us a limited, non-exclusive license to store, process, and display Your Data solely for the purpose of providing the Service to you.
Data accuracy: You are responsible for the accuracy and legality of Your Data. You represent that you have the right to enter and process all client and property data you submit to TurfWize, and that doing so does not violate any applicable laws or third-party rights.
Anonymized data: As described in our Privacy Policy, we may collect and use anonymized, aggregated data derived from your usage. You may opt out of this collection at any time in Settings. See our Privacy Policy for full details.
Data export: You may request an export of Your Data at any time by contacting support@turfwize.com. We will provide your data in a standard format within 30 days.
TurfWize includes AI-powered features including a conversational business assistant, optimizer insights, and zone suggestions. These features are powered by third-party AI providers including Anthropic.
AI limitations: AI-generated responses, suggestions, and insights are provided for informational purposes only. They do not constitute professional business, legal, financial, or operational advice. You are solely responsible for decisions made based on AI-generated content.
Accuracy: AI features may produce inaccurate, incomplete, or outdated information. We do not warrant the accuracy or reliability of any AI-generated output.
Data processing: When you use AI features, relevant portions of your business data are sent to third-party AI providers for processing. This is described in our Privacy Policy.
TurfWize, including its software, design, features, algorithms, and content, is owned by Stormwater Dynamic Solutions LLC and is protected by intellectual property laws. "TurfWize" is a trademark of Stormwater Dynamic Solutions LLC.
You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes. This license does not include the right to copy, modify, distribute, sell, or create derivative works based on the Service.
By you: You may cancel your subscription and close your account at any time through the app or by contacting support@turfwize.com.
By us: We may suspend or terminate your account at any time for violation of these Terms, non-payment, fraudulent activity, or any conduct we determine to be harmful to TurfWize or other users. We will provide notice where reasonably practicable.
Effect of termination: Upon termination, your right to use the Service ceases immediately. Your data will be retained for 30 days and then permanently deleted. Sections of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, and limitations of liability.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant that route optimization, task estimates, or AI suggestions will be accurate or optimal for your specific business needs.
TO THE FULLEST EXTENT PERMITTED BY LAW, STORMWATER DYNAMIC SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Stormwater Dynamic Solutions LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, violation of these Terms, or violation of any third-party rights.
These Terms are governed by the laws of the State of Missouri, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Missouri.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
We may update these Terms from time to time. We will notify you of material changes by email or in-app notification at least 30 days before the changes take effect. Your continued use of TurfWize after the effective date constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription before the effective date.
